Again, you have chosen to ignore the mediation agreement, which is par for the course. Your last text indicated and inferred that you had successfully tested your [webcam software] connection and we would “C [sic]” [daughter] this evening. Not testing your [webcam software], FOUR WEEKS IN A ROW, is no excuse for disappointing [daughter] (and her disappointment was evident in her voice.)
We never agreed to replace the video contact this evening, with a half-hearted phone call.. of course I am as usual desperate for A[other state] [daughter]-contact so I take what I can get. However, your non-compliance and your disregard for the order is obvious. It is clear you have no intention of abiding by any order of the court. Again, you are costing us both money through your non-actions. You are costing [daughter] much more by refusing to allow her a chance at a relationship with her family.
Further, there is no order for supervised phone contact. Your eavesdropping, possible recording and interference with the most basic of contact has been noted and will be addressed through my attorney. having [daughter] on speakerphone is distracting for her because we can not hear one another and she is prone to engaging in other activities leaving her distracted and uninterested. Please refrain from doing so in the future.
Attached for reference is the log of text messages this evening for my attorney’s review.
