Hi, [Custodial Dad].
Glad you appreciated last week’s update. She is such a sweet child.  We are very blessed parents!

Please give me the reference to the [other  state] law/ statute to which you refer and I will gladly comply with my legal obligation. I want us to come to a resolution of this discord.
[daughter] and all the children deserve a peaceful relationship with all their parental figures.  It is good and healthy for us all. Please let me know when you want to have [daughter] visit and I will gladly arrange for her to be up North to have time with all of you.

Presents for the children are prepared and waiting here in our [other state] home just for her bothers and sister. (please let me know if you are expecting or have another (re: your email of “5 children”).  We would like to have gifts for all of [daughter]’s siblings... it would be important to her, even if you are still expecting.   She grasps enutero life as real and would want to have a present waiting for her sibling’s arrival!)
So, please let me know of [daughter]’s siblings count at present, including expectations!  :) How delightful!
I will be glad to bring [daughter] to visit you all up North.  Just give me good days/ dates and times.

I will make sure it happens! :)

I respect your request to have [daughter] with her [last name] family.  It is important for [daughter] and thus for all of us.

Let us coordinate dates for [daughter] to come up North, and work to fulfill your request of having her in your home.

In summary:
Please send me dates/times for [daughter]’s visit to you all.
Please let us know how many “[daughter] 2007-2008 creations” we can bring as gifts.
Please send the [other  state] statute and law... or even a web site... I will comply with the responsibility to provide you with all the information you request.
Please, no more lawyer to lawyer, costly processes.  I am not able to finance it.
I am doing my best to provide for [daughter]’s needs.  I beg of you not to cost me money for information getting...
I respect the law... let me know what things I am required to share with you and the legal reference for me to read on-line/ in the courthouse library.
This is a plea for alow cost process.  I will give you all the information which you are legally entitled to have for [daughter].
Give me a chance and my exact legal obligation/ responsibilities please.
Thanks, [Custodial Dad].
I beg of you to try to work with me... it is not a fight.  I have taken care of our daughter, with your eyes and thick beautiful hair- and an Irish smile that melts your heart!
Let us work through this kindly.
It is a long road ahead to continue to raise [daughter] and her sibblings.  Let’s make it all peaceful and joyful! :)
God Bless, on this bright Sunday morning.
I will have [daughter] call as soon as she requests/ agrees to speak with you all.
Enjoy your coffee.
Kindly,
[The Ex] [last name]

Thank you for addressing several questions I had but I assume you have no intention of allowing me the most fundamental knowledge of [daughter].  I will address this further with my attorney since you have no legal basis of restricting such information and it is in direct opposition of [other state] law.
Again, I would love if you would allow [daughter] to visit her siblings and I in [home state].  I have been requesting such visits since February and would be happy to secure [daughter] a plane ticket ASAP!

Hi, [Custodial Dad].
[daughter]’s overall health is wonderful, thank goodness for us all.
She is so excited about attending first grade!
[daughter] is active in rollerblading, ice-skating lessons, and swimming lessons.
She is lovin care of babies born this summer and is “big Sissy” with pride.  We are very close with a number of secure and established families in town.
[daughter] delights in participating in as a family friend/ sister/ “daughter” with teachers, classmates and neighbors’ socially- formally in extracurricular programs and informally in our homes.
[daughter] is told each day that you all love her and want to be a part of her life.
I look forward to being more effective to move your contact forward with your “Perfect Girl.”
I’m actively working on readily available options based on your assertions expressed in e-mails.
I am hopeful that you will visit her soon.
Let me know what kind of arrangements you would like to make, [other  state], [home state], nj - all are options for us at your request.
Kind regards to Mrs.[last name] and all your “[siblings]’s”!
God Bless.

Thank you for the update!  I do have several questions...
Where will she be attending first grade?  (Is she excited?)
Doe she participate in any activities regularly?  You stated she was looking into ice skating and I believe Karate.  Does she take swim lessons?
Her love of chewing gum reminded me that [daughter] mentioned some dental problems—I also carry dental coverage for [daughter] through [dental provider].

E-mail update on [daughter] [last name]- August 5th, 2008
Hi, [Custodial Dad].
Hope all is well.
[daughter] is delightfully enjoying all the joys of babies and toddlers in her life as many of our friends have had newborns and growing toddlers in the last year/ months.
She gets to hold babies and put them to bed and she just loves it all!
[daughter] defeated me terribly at air hokey- she is quite a player!
She is reading chapter books- prefers books on magical flower faries- of her own kind:)
She is preping for first grade with mastering time-telling, learning new vocabulary and writing complete sentences which she composes independently.
[daughter] loves to swim and she is now able to do handstands in the pool!
She wears her glitter shoes at any chance and enjoys rollerblading in full gear when not in “fancy shoes.”
Hanna Montana is still the favored pop star, for many her age!
Loves her classic pasta, broccoli and steak.  Sushi is well integrated into her diet and she loves the dining experience.
She delights in chewing gum and blowing bubbles!
[daughter] says that she is happy with her summer.  As always, she is active and healthy.
And I think we have an attorney in bloom when she speaks!  Must be genetic!
She is the best of both of us and all those around her.
Take care.
(Congrats !!!  on your new child, as I got a message from you that you are parenting 5(five) children.
Pardon me if I am incorrect.   Send pictures for [daughter]’s family album if I am correct!)
Kind Regards,
[The Ex] [last name]

Subject: [The Ex] [last name]’s Final request for Parenting IM Communication.

Hi, [Custodial Dad].

This is my final request for you to reconsider the 4-5:45AM window.

I have a very strict schedule dictated by single-parenting/ guiding [daughter]’s development, enrichment, care and my school responsibilities.

I am doing my best to set a schedule with you which will not change for a year

as to ensure consistent parenting contact between us.

I respect your request of a co-parenting option.

Please, reconsider.  Wake up 20 minutes earlier one day in the week, please.

Email is not IM.  Weekly inquiries can be immediately responses on IM,
as it is instant message option, by definition.

It is efficient and well utilized by many in our situation.

Thank you for your consideration.
Kindly,
[The Ex]

[The Ex];
Suffice to say that at this juncture, I am completely UNAVAILABLE.  I am uncomfortable givin you the intimate details of my schedule.  I wish for you to reconsider your own schedule at this time.  I have evening hours available that we can accomplish your requested IM session after [daughter] is in bed or my best suggestion; simply email me an update. Looking at today’s back and forth, I could have been updated three times over.  Since you will include what it is yo

 [The Ex];
Here is the [other state] Statute in its entirety relating to access to information in regards to [daughter].  The presumption being that I would already have her address and is thereby presumed. Access to the statutes are available online for ease of your research.
[other  state]A. STAT. ch 61.13.3
Access to records and information pertaining to a minor child, including, but not limited to, medical, dental, and school records, may not be denied to either parent. Full rights under this subparagraph apply to either parent unless a court order specifically revokes these rights, including any restrictions on these rights as provided in a domestic violence injunction. A parent having rights under this subparagraph has the same rights upon request as to form, substance, and manner of access as are available to the other parent of a child, including, without limitation, the right to in-person communication with medical, dental, and education providers.
Very honestly, I can be available ANY time for [daughter] to visit.  I will make all the time in the world to see [daughter].  Whenever your schedule permits, please advise and I will be happy to secure a plane ticket for [daughter] as I stated before.
I truly appreciate your change of attitude in allowing [daughter] to have more of a real relationship with her entire family and for your (hopeful) allowance in my having a more active roll in [daughter]’s life.

 [The Ex];
After reviewing my past files and messages, both my [home state] attorney ([Custodial Dad’s home state lawyer]) and [other  state] attorney ([Custodial Dad’s other state lawyer]) requested specific information in regards to [daughter] through your respective attorneys consistently over the past year and a half (not to mention my requests over the years.)  It seems unlikely that they all ({The Ex third home state lawyer], [The Ex second home state lawyer] and [last name]) would fail to inform you of the current statutes that prohibit withholding such information.  I figured by providing the actual statute and givin you ample time to review it, you would comply but you have failed to do so, yet again.

After speaking briefly with my attorney, it is apparent that your attorney, Ms. [last name], is within her realm of using delay tactics.  She is fighting each technical aspect of the case instead of just complying and moving forward.  If you are in true financial constraints, you may want to review legal strategies with her specifically as this should have been handled long ago.  Understand that while Ms. [last name] and you have at the very least, an acquaintanceship, I am paying full fees and expenses for my attorney.  I would be thrilled if we could work things out between us but it is apparent that is not not feasible at this time.
On a side note, I have forwarded my authorization to Ms. [therapist in other state] this afternoon. Please let me know how I can be of further assistance in regards to [daughter]’s therapy sessions.
Lastly, as I stated previously, the week of August 25th is the week that  would be ideal for [daughter] to visit.  I assume [daughter] is in the [other state county] County school district and from the Public School Newsletter it appears she returns on the 18th. Please advise on when you intend to visit ASAP as it appears there is only one week until her school begins.

 A few points to consider:
I sent my authorization to Ms. [therapist in other state] on August 11, 2008.  To date, you have failed to remit payment and/or your authorization to get [daughter] the help you have been insisting she needs.  (A reminder that it will be reimbursed through [insurance company] at 70%.) You have also promised me a copy of your authorization for my own records. The last time I spoke with [daughter] via webcam or otherwise was on July 28, 2008 (and the call was very brief) is her next call contingent on Ms. [therapist in other state]?  We were making some progress, let us not go backwards into bad patterns.
You insisted to me that you sent some form of “Disclosure” and when I asked for clarification, I understood that this is not regarding Ms. [therapist in other state].  I have yet to receive it and I have no idea what it relates to.  I have two assumptions, that it is related to the financial matters handled through the attorneys or that you are finally complying with the mandatory disclosure of [daughter]’s pertinent information.  Either way, please re-send the information.
Despite your “promise” to allow [daughter] to come visit [home state], you have made no indication as to when and/or if you intend to make such a visit.  I can not tell you the disappointment that my children and [daughter]s’ Grandmother felt when I had to inform everyone that [daughter] was not coming to [home state].  I understand that it has no bearing on you but your lack of commitment has long reaching consequences not only to [daughter] but to her brothers and sister, Grandmother, Uncles, Aunts - etc as well.  Please let me know when [daughter] would be available for ANY visit...
After speaking with you and my attorney, it is my understanding that [daughter] started school on Monday.  In your next e-mail update, please include how her first week was.
Thank you;
x
